Welcome to StefGPT, a product of Kosmic Consciousness, LLC. StefGPT is an AI model intended for educational and entertainment purposes. These terms and conditions outline the rules and expectations for the use of this service. By accessing StefGPT you warrant and represent that you accept these Terms and Conditions of Service and Use in full, and Kosmic Consciousness, LLC is relying on that warrant and representation.  Do not continue to use StefGPT if you do not accept all of the terms and conditions stated hereinafter.

1.0 Intended Use and Limitations.  StefGPT is designed to assist with a range of tasks and queries but comes with its own set of limitations. While interacting with StefGPT, it is crucial to remember that these are machine-generated responses, not advice from qualified professionals. StefGPT is not intended for providing emotional, marital, medical, mental health, financial, legal, or any other type of professional advice. You should seek the services of a qualified medical, healthcare, or coaching professional for such advice.  StefGPT is for entertainment and educational purposes.

2.0 Acceptance of Terms.  By using StefGPT, you agree to be bound by these Terms and Conditions of Service and Use in full.  If you do not agree with any of these terms, you are prohibited from using or accessing StefGPT.

2.1 Changes to the terms.  Kosmic Consciousness, LLC reserves the right to update or change these terms and conditions at any time. Your continued use of StefGPT following the posting of any modifications to these Terms and Conditions of Service and Use will constitute acceptance of those changes. It is recommended you regularly check this document to stay informed.

2.2 Access and use of the service.  Access to and use of StefGPT is permitted on a temporary basis, and Kosmic Consciousness, LLC reserves the right to withdraw or amend the service without notice. You are responsible for making all arrangements necessary for you to have access to this service. You are also responsible for ensuring that all persons who access this service through your internet connection are aware of these Terms and Conditions of Service and Use, and that they comply with them.

3.0 User Acknowledgements.  This section highlights important aspects you need to be aware of when interacting with StefGPT.

 3.1 Not a real person.  It is crucial to understand that the StefGPT model you are interacting with is not human. It does not possess emotions, qualifications, or the ability to understand context in the way a human does. You should not rely on StefGPT for specialized emotional, marital, medical, mental health, financial, legal, or any other type of professional advice. You should seek the services of a qualified medical, healthcare, or coaching professional for such advice.  This AI model is for entertainment and educational purposes.

3.2 Use at your own risk.  By using StefGPT, you acknowledge that you are doing so at your own discretion and risk. Kosmic Consciousness, LLC does not guarantee the accuracy or reliability of any information provided by StefGPT.

3.3 User content.  You are solely responsible for the accuracy, legality, and propriety of any data, text, files, information, usernames, images, graphics, photos, profiles, applications, links, and other content or materials that you submit to StefGPT. Once provided, your data will be managed responsibly and in accordance with the Data Handling and Privacy Policy set forth in section 8.0 below, and any relevant data protection laws.

3.4 Potential for errors.  Please be aware that StefGPT can generate incorrect, misleading, or nonsensical information and responses. These outputs, sometimes referred to as “hallucinations,” are a limitation of the current technology, and Kosmic Consciousness, LLC does not have control over them.

3.5 Abuse and misuse.  Users are expected to interact responsibly with the StefGPT. Any attempt to make the AI generate hateful, illegal, or offensive content is strictly against these Terms and Conditions of Service and Use, and will constitute a violation of them which may result in terminating you use of StefGPT without warning.

3.6 Minors.  StefGPT is not intended for use by minors.  Persons under the age of 18 should not use this service without parental supervision and consent.

3.7 Compliance with all laws.  You represent and warrant that your use of StefGPT will comply with all applicable laws and regulations. You are solely responsible for determining whether StefGPT is suitable for you to use in light of any regulations, like EU Data Privacy Laws or any other law of any country or jurisdiction. If you are subject to regulations (like HIPAA) and you use StefGPT, please note that Kosmic Consciousness, LLC will not be liable for any personal medical/healthcare information provided, or if the service does not meet those requirements. You may not use StefGPT for any unlawful or discriminatory activities, including acts prohibited by the Federal Trade Commission Act, Fair Credit Reporting Act, Equal Credit Opportunity Act, or other laws that apply to commerce in any country or jurisdiction.

4.0 Intellectual Property Rights.  StefGPT owns the intellectual property rights for all material used in this services, including and any inventions, devices, software, mask works, and technologies related thereto, including all derivatives, modifications, and revisions thereof regardless of when the same was first conceived. All intellectual property rights are reserved (with the exception of third-party products).

5.0 Disclaimer of Warranties; Limitation of Liability.  

5.1 Kosmic Consciousness, LLC does not guarantee, represent, or warrant that your use of StefGPT will be uninterrupted, timely, secure, or error-free.

5.2 Kosmic Consciousness, LLC does not warrant that the results that may be obtained from the use of StefGPT will be accurate or reliable.

5.3 You agree that from time to time Kosmic Consciousness, LLC may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

5.4 You expressly agree that your use of, or inability to use, StefGPT is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided “as is” and “as available” for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

5.5 To the fullest extent permitted by applicable law, in no case shall Kosmic Consciousness, LLC, its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of StefGPT or any products procured using StefGPT, or for any other claim related in any way to your use of StefGPT or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of StefGPT or any content (or product) posted, transmitted, or otherwise made available via StefGPT, even if advised of their possibility. Because some countries, states, or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, Kosmic Consciousness, LLC’s liability shall be limited to the maximum extent permitted by law.

6.0 Indemnification.  You agree to indemnify, defend and hold harmless Kosmic Consciousness, LLC, and all parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions of Service and Use, or your violation of any law or the rights of a third-party in using StefGPT.

7.0 Termination.  Kosmic Consciousness, LLC may terminate or suspend your access to StefGPT immediately, and without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions of Service and Use.

8.0 Data Handling and Privacy Policy.  Your data privacy is important. This section will clarify how your data is managed when you interact with StefGPT.

8.1 Data collection and usage.  When you engage with StefGPT on this platform, certain types of data may be collected, including but not limited to, the content of your chats, your name, and your email address. This information is accessible to the Creator of the specific AI model you interact with as well as Kosmic Consciousness, LLC.

8.2 Data retention.  Your data will be stored indefinitely unless you request its deletion. To initiate the data deletion process, you will need to contact [email protected].

8.3 Data sharing.  Your data will not be shared with any third parties beyond Kosmic Consciousness, LLC and the Creator of the specific AI model you interact with. If the Creator has additional data sharing practices, those will be outlined in their own privacy policy and terms of business.

8.4 Use for sales and marketing.  By interacting with AI models developed on this platform, you acknowledge that your data may be used for sales and marketing purposes. You should consult the Creator’s own privacy policy and terms of business to understand how your data might be used in this context.

8.5 Data deletion.  Should you wish for your data to be “forgotten” or deleted, please contact the Creator of the AI model directly. If the Creator does not comply with your request in a reasonable timeframe, you may escalate the issue by contacting Kosmic Consciousness, LLC.

9.0 General Provisions.

9.1 No partnership or agency. Nothing herein contained shall be interpreted so as to create a partnership or agency relationship between you and Kosmic Consciousness, LLC.

9.2 Severability. If there is a final judicial or arbitral determination that any term or provision of these Terms and Conditions of Service and Use are illegal, invalid, or unenforceable in any jurisdiction, then the illegality, invalidity, or unenforceability of that term or provision shall not affect the legality, validity, or enforceability of that term or provision in any other jurisdiction, and all other terms and provisions herein shall nevertheless remain in full force and effect.

9.3 Governing law, dispute resolution, and waiver of jury trial. These Terms and Conditions of Service and Use shall be governed by and be construed in accordance with the laws of the United States and the laws of Texas applicable therein.  If a dispute arises between the you and Kosmic Consciousness, LLC, both parties agree to mediation in Travis County, Texas, United States of America, before escalating the dispute to arbitration. Any controversy or claim arising out of or relating to these Terms and Conditions of Service and Use, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. There shall be one (1) arbitrator. The place of arbitration shall be Austin, Texas, United States of America. You and Kosmic Consciousness, LLC each consent to this method of dispute resolution, as well as jurisdiction, and consent to this being a convenient forum for any such claim or dispute, and waive any right to object to either the method or jurisdiction for such claim or dispute, INCLUDING WAIVING THE RIGHT TO A TRIAL BY JURY.  In the event of any dispute, the prevailing party as that is defined under Texas law shall be entitled to recover damages plus reasonable costs and attorney’s fees, and the decision of the arbitrator shall be final, binding and enforceable in any court.

9.4 Entire agreement. These Terms and Conditions of Service and Use comprise the entire agreement and understanding between you and Kosmic Consciousness, LLC in connection with the use of StefGPT. There are no representations, warranties, terms, conditions, undertakings, or collateral agreements, express or implied, other than as expressly set out in herein.
